Bill of sale guide

Florida vehicle bill of sale

Florida requires a bill of sale only in some cases, explained below. No notary is needed. Here's what to put on one and how to sell a car in Florida, from signing the title to filing the Notice of Sale.

Make your bill of sale

Fill in each section, then print it on letter-size paper or save it as a PDF. No account needed.

What are you selling?

Florida has an official bill of sale form: Notice of Sale and/or Bill of Sale for a Motor Vehicle, Mobile Home, Off-Highway Vehicle or Vessel (HSMV 82050). Check whether your motor vehicle office wants that form. Open the official form

Florida doesn't require a notary for a bill of sale. You can still add a notary block.

Seller

Add everyone named on the title as an owner. If their names are joined by "and", each one signs.

Buyer
Vehicle

It's on the title and registration, at the base of the windshield on the driver's side, and on the label in the driver's door jamb.

Odometer

Whole miles only. Federal rules say no tenths.

The seller states that this reading:

Choose the one that's true. Mechanical limits is for an odometer that has rolled past its highest number.

This doesn't replace the odometer section on the title. If the title has one, fill it in too.

Sale
Type of transfer

Print two copies. You and the buyer sign both, and each keeps one.

Nothing you type is saved or sent anywhere. The VIN lookup sends only the VIN.

This is general information, not legal advice. Check your state's requirements before you sign.

Do you need a bill of sale in Florida?

A bill of sale is required when the title is an open title, meaning the buyer's name or the selling price is missing, or when the selling price was altered. It must be signed by the seller and the buyer. Form HSMV 82050 can be used as the bill of sale. FLHSMV recommends having a bill of sale notarized, but notarization is not required.

Use the official form if you prefer it: Notice of Sale and/or Bill of Sale for a Motor Vehicle, Mobile Home, Off-Highway Vehicle or Vessel (HSMV 82050).

What a Florida bill of sale must include

Florida lists these items:

  • Name of the purchaser
  • Selling price
  • Complete description of the vehicle
  • Signatures of the seller and purchaser

How to sell a car in Florida

  1. Pay off any lien first. Florida does not allow a private sale of a vehicle with an existing lien.
  2. Replace a lost paper title with a duplicate (HSMV 82101) before the sale. For an electronic title, go with the buyer to a motor vehicle service center.
  3. If the vehicle was not titled in Florida before, complete a VIN and odometer verification (HSMV 82042).
  4. Fill in the Transfer of Title by Seller section on the front of the title: buyer's name and address, odometer reading, selling price and date sold.
  5. Sign the title. No notary is needed, even if the title has a notary space.
  6. Remove your license plate from the vehicle.
  7. File a Notice of Sale within 30 days, using HSMV 82050 or the Notice of Sale section on the back of the title.
  8. Keep copies of the bill of sale, the title and other sale documents.

Notice of Sale in Florida

Required. File Notice of Sale and/or Bill of Sale for a Motor Vehicle, Mobile Home, Off-Highway Vehicle or Vessel (HSMV 82050) within 30 days of the sale. It protects you if the buyer gets tickets or tolls, or abandons the car, before retitling it.

What happens to your license plates when you sell a car in Florida?

In Florida, plates stay with the seller, not the vehicle. Remove the plate when you sell. You may transfer it to a new or replacement vehicle. You must surrender it at a motor vehicle service center if you move to another state or cancel the insurance on the vehicle tied to the plate.

Inspection, odometer and sales tax in Florida

Inspection. None tied to the sale. FLHSMV's selling guidance lists no safety or emissions inspection. A VIN and odometer verification (HSMV 82042) is required if the vehicle was not previously titled in Florida.

Odometer disclosure. The seller records the odometer reading in the Transfer of Title by Seller section, and the buyer acknowledges it by signing and printing their name. Exempt under Florida law: model year 2010 and older vehicles after 10 years, model year 2011 and newer vehicles after 20 years, vehicles over 16,000 lbs gross vehicle rating, and vehicles that are not self-propelled.

Sales tax. The buyer pays 6% Florida sales tax on the sales price when titling at a motor vehicle service center. If the buyer lives in a county with a discretionary sales surtax, the surtax applies to the first $5,000 of the price. The selling price must be shown on the title, or on a bill of sale if the title is open.

Common questions

Does a bill of sale need to be notarized in Florida?

No. FLHSMV recommends having it notarized but does not require it. The seller's section of a Florida title does not need a notary either, even if it has a notary space.

What happens to my license plates when I sell my car in Florida?

They stay with you. Remove the plate when you sell, and you may transfer it to another vehicle. You must surrender it if you move out of state or cancel the vehicle's insurance.

Do I have to report the sale of my car in Florida?

Yes. Florida law requires sellers to file a Notice of Sale within 30 days, using Form HSMV 82050 or the Notice of Sale section on the back of the title.

When is a bill of sale required in Florida?

When the title is open, meaning the buyer's name or the selling price is missing, or when the price was altered. The bill of sale must give the buyer's name, the price and a complete vehicle description, and both parties must sign it.
