Arkansas's data breach notice law

Arkansas's breach notice law is Ark. Code Ann. § 4-110-105. If personal information of Arkansas residents is breached, it says to notify them in the most expedient time and manner possible and without unreasonable delay, consistent with the legitimate needs of law enforcement or measures necessary to determine the scope of the breach and restore system integrity.

Who else to tell: the Attorney General. If the breach affects the personal information of more than 1,000 individuals; at the same time individuals are notified or within 45 days after determining there is a reasonable likelihood of harm, whichever occurs first (§ 4-110-105(b)(2), added by Act 1030 of 2019). Written breach determination must be kept 5 years and sent to the AG within 30 days of a written request.

The law reads: "The disclosure shall be made in the most expedient time and manner possible and without unreasonable delay, consistent with the legitimate needs of law enforcement"

This is on top of the federal rule. Under the FTC Safeguards Rule, a dealer must tell the FTC within 30 days of discovering a breach of unencrypted information about 500 or more consumers. How the FTC notice works.

Does Arkansas have a consumer privacy law?

Arkansas has no comprehensive consumer privacy law like California's as of October 31, 2026. The federal privacy rules still apply: a dealer that arranges financing or leases gives each of those buyers a privacy notice under the Gramm-Leach-Bliley Act. Make a free GLBA privacy notice.
