Florida's data breach notice law
Florida's breach notice law is Fla. Stat. § 501.171. If personal information of Florida residents is breached, it says to notify them as expeditiously as practicable and without unreasonable delay, but no later than 30 days after the determination of a breach or reason to believe a breach occurred (unless delayed at law enforcement's written request or waived under the no-harm provision).
Who else to tell: the Department of Legal Affairs (Attorney General). If the breach affects 500 or more individuals in Florida; as expeditiously as practicable, but no later than 30 days after the determination of the breach or reason to believe a breach occurred (15 additional days available for good cause shown in writing within 30 days). Nationwide consumer reporting agencies also if more than 1,000 individuals are notified at one time.
The law has a clause for businesses that follow the breach rules of their own federal regulator (Fla. Stat. § 501.171(4)(g) (notice under the rules of the covered entity's primary or functional federal regulator is deemed compliance with individual notice; timely giving the department a copy is deemed compliance with subsection (3))). Some clauses like this cover only banks and credit unions, so don't count on it: plan to meet the state deadline as well as the FTC's.
The law reads: "but no later than 30 days after the determination of a breach or reason to believe a breach occurred unless subject to a delay authorized under paragraph (b) or waiver under paragraph (c)."
This is on top of the federal rule. Under the FTC Safeguards Rule, a dealer must tell the FTC within 30 days of discovering a breach of unencrypted information about 500 or more consumers. How the FTC notice works.
Does Florida have a consumer privacy law?
Florida has no comprehensive consumer privacy law like California's as of October 31, 2026. The federal privacy rules still apply: a dealer that arranges financing or leases gives each of those buyers a privacy notice under the Gramm-Leach-Bliley Act. Make a free GLBA privacy notice.
