Oregon's data breach notice law
Oregon's breach notice law is ORS 646A.604. If personal information of Oregon residents is breached, it says to notify them in the most expeditious manner possible, without unreasonable delay, but not later than 45 days after discovering or receiving notification of the breach.
Who else to tell: the Attorney General. If more than 250 consumers must be notified; in writing or electronically (no separate deadline stated).
The law has a clause for businesses that follow the breach rules of their own federal regulator (ORS 646A.604(9)). Some clauses like this cover only banks and credit unions, so don't count on it: plan to meet the state deadline as well as the FTC's.
The law reads: "A covered entity shall give notice of a breach of security in the most expeditious manner possible, without unreasonable delay, but not later than 45 days after discovering or receiving notification of the breach of security."
This is on top of the federal rule. Under the FTC Safeguards Rule, a dealer must tell the FTC within 30 days of discovering a breach of unencrypted information about 500 or more consumers. How the FTC notice works.
Oregon's consumer privacy law
Yes. The Oregon Consumer Privacy Act (ORS 646A.570 to 646A.589) has applied since July 1, 2024.
Who it covers: Conducts business in Oregon or provides products or services to Oregon residents and, during a calendar year, controls or processes personal data of 100,000+ consumers (excluding payment-only data), or 25,000+ consumers while deriving 25% or more of annual gross revenue from selling personal data.
The law exempts only data covered by the Gramm-Leach-Bliley Act, not the business. Credit application data is out of scope, but website, marketing, service and cash-buyer data stay in scope if your store meets the thresholds. (ORS 646A.572(2)(k)(A))
The law reads: "The personal data of 25,000 or more consumers, while deriving 25 percent or more of the person's annual gross revenue from selling personal data."
Whether your store is covered depends on your own numbers, so check them each year, and keep giving financing buyers the federal privacy notice. Make a free GLBA privacy notice.
